For some reason I couldn't post comments on Todd's previous post so here is my comment.

I would say the backer is more at fault. Although one that was hit seems to have been careless too. Why didn't they just honk the horn instead of stopping and trying to put the car in reverse? But when you are backing up you need to watch.

And just so you know I have not been eating hotdogs before giving this advice.
